Common questions
about trademarks.

The typical timeline for trademark registration in Canada is 18-24 months from filing to registration. This includes the examination period (4-8 months), publication for opposition (2 months), and final registration processing. I keep you informed at every stage and work to expedite the process where possible.
In Canada, you can trademark words, names, slogans, logos, designs, sounds, textures, tastes, scents, holograms, moving images, and the mode of packaging goods. The key requirement is that your trademark must be distinctive and not confusingly similar to existing registered marks.
While not legally required, working with a trademark lawyer significantly increases your chances of success. I conduct thorough clearance searches, properly classify your goods and services, and handle any objections from CIPO—saving you time, money, and the risk of refusal.
A Canadian trademark registration lasts for 10 years from the date of registration. You can renew your registration indefinitely for additional 10-year periods. I offer trademark monitoring and renewal services to ensure your protection never lapses.
The TM symbol can be used with any trademark, even before registration, to indicate you claim ownership. The registered symbol (R in a circle) can only be used after your trademark is officially registered with CIPO. Using the registered symbol without registration is illegal.
Yes, you can trademark your business name if it functions as a trademark—meaning it identifies your goods or services and distinguishes them from others. A business name registration alone doesn't provide trademark protection; you need a separate trademark registration with CIPO.
